Welcome to Trade with ALLAH. These Terms and Conditions ("Terms") govern your use of our application and services. By creating an account or using the app, you agree to be bound by these Terms. If you do not agree, please do not use the application.

1. Introduction and Entity Information

Trade with ALLAH is operated by an individual based in Manitoba, Canada. All references to "we," "us," or "our" refer to the individual owner of the application. These Terms are governed by the laws of the Province of Manitoba and the federal laws of Canada.

2. User Accounts

To access certain features of the app, you must create an account.

  • Eligibility: You must provide accurate and complete information.
  • Security: You are responsible for maintaining the confidentiality of your account credentials.
  • Responsibility: You are solely responsible for all activities that occur under your account.
  • Termination: We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or illegal activity.

3. Device Permissions and Media Uploads

To provide a full experience, the app requires access to certain device features:

Camera and Photo Library: We request access to your device's camera and photo gallery to allow you to capture, select, and upload media content (such as images for your profile or listings). By granting this permission, you acknowledge that we may process and store these files on our servers to display them within the app.

Geolocation: The app may request access to your location data to provide location-based services (such as identifying local trades or verifying regional compliance). You can enable or disable location services through your device settings at any time, though some features may become unavailable as a result.

4. User-Generated Content

Our app allows users to create, upload, or share content, including but not limited to text and images.

Ownership: You retain ownership of the content you post. However, by uploading content, you grant Trade with ALLAH a worldwide, non-exclusive, royalty-free license to use, display, and distribute that content within the app's ecosystem.

Prohibited Content: You agree not to upload content that is:

  • Illegal, hateful, or discriminatory.
  • Infringing on the intellectual property rights of others.
  • Explicit, obscene, or defamatory.
  • Spam or intended for phishing/scamming.

Monitoring: We reserve the right, but not the obligation, to monitor and remove content that we deem inappropriate or in violation of these Terms.

5. Intellectual Property Infringement (Notice and Notice)

We respect the intellectual property of others. In accordance with Canada's Copyright Act, if you believe your work has been infringed upon within our app, please send a formal notice to our designated agent:

Your notice should include:

  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the material that is claimed to be infringing and its location in the app.
  • Your contact information (address, telephone number, and email).
  • A statement of good faith belief that the use is not authorized.

6. Privacy and Data Protection

Your privacy is important to us. We handle personal information, including location data and media metadata, in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA).

  • We collect only the data necessary to provide our services (e.g., account details, location, and uploaded media).
  • We do not sell your personal data to third parties.

7. Limitation of Liability

To the maximum extent permitted by the laws of Manitoba:

  • Trade with ALLAH is provided on an "as-is" and "as-available" basis.
  • We are not liable for any indirect, incidental, or consequential damages arising from your use of the app, including loss of data, unauthorized access to media, or financial loss.
  • We do not guarantee the accuracy of any user-generated content or third-party information.

9. Changes to Terms

We may update these Terms from time to time. We will notify users of significant changes by posting a notice within the app or via email. Your continued use of the app after such changes constitutes acceptance of the new Terms.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Manitoba and the federal laws of Canada applicable therein. Any disputes shall be settled in the courts of Manitoba.

By clicking "I Agree" or using the Trade with ALLAH app, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.

أتعهد بأن لا أستخدم هذا التطبيق إلا عند الحاجة الحقيقية للمساعدة، وأن يكون استخدامي له في العمل الخيري، وألا أستخدمه فيما يخالف القانون أو يضر بالناس، والله على ما أقول شهيد
I pledge that I will not use this application except when I am truly in need of help, that my use of it will be for charitable work, and that I will not use it in any way that violates the law or harms people. ALLAH is witness to what I say.

As Volunteers

بصفتي متطوعًا، أتعهد بالالتزام باستخدام هذا التطبيق حصراً لأغراض مساعدة المحتاجين، وألتزم بعدم استخدامه في أي أعمال أو أنشطة تخالف التعاليم الدينية أو القيم الأخلاقية أو القوانين المعمول بها، والله على ما أقول شهيد
As a volunteer, I hereby commit to using this application exclusively for the purpose of assisting people in need, and I commit to not using it in any activities or actions that violate religious teachings, moral values, or applicable laws. ALLAH is Witness to what I say.

Important Liability Disclaimer

يقرّ ويوافق المتطوع إقرارًا صريحًا ونهائيًا على أن التطبيق والمنظمة لا يتحمّلان أي مسؤولية، مباشرة أو غير مباشرة، مالية أو قانونية، حالية أو مستقبلية، ناشئة عن أو متعلقة بجودة الخدمة المقدَّمة أو آثارها أو نتائجها، أياً كان نوعها. كما يقرّ المتطوع بأن المسؤولية القانونية والمالية كاملةً وحصرية تقع على عاتقه بصفته مقدّم الخدمة، ويتحمل وحده كافة المطالبات أو الدعاوى أو الأضرار أو الخسائر، دون أدنى مسؤولية على التطبيق أو المنظمة
The volunteer explicitly and irrevocably acknowledges and agrees that the application and the organization bear no direct or indirect, financial or legal, present or future liability arising from or related to the quality of the service provided, its effects, or outcomes of any kind. The volunteer further acknowledges that full and exclusive legal and financial responsibility rests solely with them as the service provider, and they shall bear all claims, lawsuits, damages, or losses, without any liability whatsoever on the part of the application or the organization.
